TERMS AND CONDITIONS OF STAY

These terms govern availability requests, bookings and stays at La Casetta della Cittadella, located in Pitigliano (GR), hereinafter also referred to as the "Property" or "Casetta".
Submitting a booking request and, subsequently, receiving confirmation of the booking from the Host entails acceptance of these terms by the guest(s).

1. Subject of the stay

La Casetta della Cittadella is an apartment intended exclusively for temporary stays for tourism purposes.
The apartment may accommodate a maximum total number of 4 guests, including adults and children, unless otherwise expressly and previously authorised by the Host.
The number of persons actually staying in the apartment must correspond to the number stated in the booking and communicated to the Host.
It is not permitted to accommodate persons in the apartment who are not registered or have not been previously authorised by the Host.
The Host reserves the right to deny access or terminate the stay if the number of occupants exceeds the authorised number.

2. Booking request and confirmation

A request made through the website, by email, telephone, messaging service or other channels does not automatically constitute confirmation of a booking.
A booking shall be deemed confirmed exclusively after confirmation has been communicated by the Host according to the agreed arrangements.
The Host reserves the right not to accept a booking request, informing the interested party where possible.
The guest is required to provide truthful, complete and up-to-date information and to promptly communicate any changes relating to occupants or their needs.

3. Rates and price changes

Rates published on the website, in listings or through other sales channels are subject to change and may be amended by the Host at any time and without prior notice for new requests and bookings not yet confirmed.
The price applicable to an already confirmed booking is the one communicated and accepted at the time of confirmation, except for any taxes, duties, charges or mandatory costs subsequently introduced or amended by law or by the competent authorities.
Any services, supplements or additional requests not included in the booking price will be communicated and agreed separately.

4. Payment methods and terms

The payment methods for the stay will be communicated by the Host at the time of booking confirmation.
Any amounts due for additional services, supplements, pets, cleaning, tourist tax or other charges not included in the rate shall be paid according to the methods indicated by the Host.
Failure to pay amounts due may result in keys not being handed over or in termination of the stay, within the limits permitted by applicable law.

5. Tourist tax

The guest is required to pay the tourist tax provided for by the Municipality of Pitigliano, according to the amounts, methods, possible exemptions and limits established by municipal regulations in force at the time of the stay.
The tourist tax is a charge separate from the accommodation price and must be paid according to the methods communicated by the Host, normally upon arrival.
The rules governing the tourist tax are established by the Municipality of Pitigliano and may be amended by the competent authorities.
The guest is required to provide the information and documentation necessary for the possible application of exemptions or reductions provided for by the regulations.

6. Cleaning

For each stay, a final cleaning contribution of € 10.00 is required, payable upon arrival, unless otherwise communicated to the guest.
The contribution includes the ordinary cleaning of the apartment at the end of the stay.
If the apartment is left in particularly dirty conditions, with abandoned rubbish or materials, stains, residues, damage or a need for extraordinary cleaning, the Host may request reimbursement of the actual costs incurred.

7. Check-in

Check-in is available from 3:00 pm to 10:00 pm on the day of arrival.
The guest is required to promptly inform the Host of their estimated arrival time.
Any request to arrive outside the scheduled time slot must be agreed in advance with the Host and may be subject to availability and possible additional costs.
The Host does not guarantee check-in outside the stated hours without prior authorisation.

8. Check-out

Check-out must be completed by 10:30 am on the day of departure.
The apartment must be vacated of persons and personal belongings by that time, and keys/access devices must be returned according to the instructions received.
Any late check-out request must be agreed in advance with the Host.
Failure to comply with the check-out time, if it causes inconvenience, delays or additional costs for the Host or for apartment cleaning and preparation activities, may result in the charging of actual costs incurred and, in more serious cases, any further documented costs.

9. Electronic key and access devices

Upon arrival, the guest may be given one or more keys, cards, electronic devices or other tools necessary to access the Property.
Such devices remain the property of the Host.
In the event of loss, failure to return or damage to the electronic key or access device, an amount of € 20.00 shall be due as a management and replacement cost.
If the loss makes it necessary, for security reasons, to replace additional devices or access systems, the Host reserves the right to request reimbursement of the additional actual and documented costs incurred.

10. Care of the apartment and liability for damage

The guest is responsible for the proper care of the apartment, furniture, appliances, equipment, keys and all other property present in the Property during the stay.
The guest is required to use the apartment and its equipment with ordinary care and in accordance with their intended use.
Any damage, breakage, missing items, unusual deterioration or theft found during or at the end of the stay may be charged to the responsible guest.
The assessment of damages will be carried out on the basis of the cost necessary for repair or replacement and, where necessary in relation to the nature or extent of the damage, by means of an assessment by a specialised technician or insurance expert and/or on the basis of estimates, invoices, purchase documentation or other suitable documentation.
The guest shall reimburse the costs reasonably necessary to restore the property and its equipment to their condition prior to the damage, without prejudice to normal wear and tear arising from proper use and the rights recognised by law.
The guest undertakes to promptly inform the Host of any damage or malfunction found during the stay.

11. Prohibition of parties and events

It is forbidden to organise parties, events, receptions, private gatherings, commercial activities or any other activity in the apartment that may disturb neighbours or involve a number of people greater than the authorised number.
It is forbidden to use the apartment for purposes other than the tourism purposes agreed with the Host.
Violation of this provision may result in the early termination of the stay, within the limits permitted by law, without prejudice to the Host's right to compensation for any damage suffered.

12. No-smoking policy

Smoking is prohibited inside the apartment.
Any need for extraordinary cleaning, deodorising, fabric treatment or restoration resulting from non-compliance with the prohibition may be charged to the guest on the basis of the actual costs incurred.

13. Pets

Pets are welcome, subject to prior notification and acceptance by the Host.
A supplement applies for pets and may vary depending on the season, length of stay and booking conditions.
The applicable amount will be communicated and agreed with the guest before final booking confirmation.
The guest is responsible for the behaviour and supervision of their pet throughout the stay and is liable for any damage, extraordinary dirt, deterioration or additional costs caused by the pet.
Pets must not be left unattended in the apartment where this may create risks to safety, cause damage to the Property or disturb third parties.

14. Additional services and experiences

Any additional services, experiences, products, breakfasts or other extras requested by the guest will be available only after availability has been verified and upon prior agreement with the Host.
The relevant prices, terms of use and conditions will be communicated to the guest before purchase or confirmation of the service.
Additional services are subject to the availability of suppliers and the Host and may be modified or unavailable for reasons beyond the Host's control.

15. Rules of conduct

During the stay, the guest is required to:

  • respect neighbours and the ordinary rules of civil coexistence;
  • avoid excessive noise;
  • comply with any applicable condominium regulations;
  • use furniture, appliances, systems and equipment correctly;
  • not make changes or carry out work on the property;
  • not permanently move furniture or equipment without authorisation;
  • not use dangerous or unauthorised equipment;
  • not bring dangerous or illegal materials into the apartment;
  • not transfer the booking or the right to occupy the apartment to third parties.
Any conduct contrary to the law or likely to cause damage, danger or serious disturbance may result in termination of the stay within the limits permitted by applicable legislation.

16. Guest identification

All guests are required to provide the data and documents necessary to comply with applicable public security and guest registration requirements.
Access to and stay in the apartment may be conditional upon the correct identification of the occupants.
The Host will process personal data in compliance with applicable personal data protection legislation and as set out in the Property's privacy notice.
For facilities and rentals subject to applicable national legislation, the Italian Ministry of Tourism recalls obligations relating to the reporting of guests and the CIN.

17. Safety

The guest is required to use the apartment in compliance with ordinary safety rules and any instructions provided by the Host.
It is forbidden to tamper with, disable or move safety devices, detectors, fire extinguishers, systems or other equipment present in the apartment.
National legislation provides for specific safety requirements for real estate units intended for short-term or tourist rentals, including, where applicable, functioning devices for detecting combustible gases and carbon monoxide, as well as fire extinguishers.

18. Personal belongings

The Host is not liable for money, documents, valuables, electronic devices or other personal belongings left unattended in the apartment, except as mandatorily provided by law.
The guest is responsible for the safekeeping of their personal belongings during the stay.
Any forgotten items may be returned according to arrangements to be agreed with the guest. Any shipping costs shall be borne by the guest.

19. Malfunctions and maintenance

The Host undertakes to maintain the apartment and its equipment in normal working condition.
Any breakdowns or malfunctions must be promptly reported to the Host to allow intervention as soon as possible.
The Host cannot be held liable for interruptions or service disruptions resulting from causes not directly attributable to the Host's control, including, by way of example, interruptions to electricity, water or internet networks, failures of public networks, weather events, measures adopted by authorities or other force majeure events.

20. Modification or termination of the stay

In the event of conduct seriously contrary to these terms, the law, the safety of the Property or the peace of neighbours, the Host may take the measures permitted by applicable law, including requesting that the conduct cease and, where applicable, early termination of the stay.
Any termination shall not prejudice the Host's right to claim compensation for any damage suffered.

21. Booking cancellation

The guest may request cancellation of the booking at any time.
In the event of cancellation by the guest, reimbursement of the amount actually paid for the stay shall be made according to the following conditions, calculated with reference to the scheduled check-in date:
a) Cancellation more than 3 months before check-in
A refund equal to 80% of the amount paid will be provided.

b) Cancellation from 3 months up to 1 month before check-in
A refund equal to 40% of the amount paid will be provided.

c) Cancellation less than 1 month before check-in
No refund of the amount paid will be provided.

For the calculation of time limits, the date and time of the cancellation request shall be those resulting from receipt of the communication by the Host.
Any refund due will be made, where possible, using the same payment method used by the guest to make the payment.
Any commissions charged by third parties, transaction costs or other charges not directly collected by the Host may be excluded from the refund where they cannot be recovered by the Host.
Any amounts already paid for additional services, experiences or third-party services shall be refundable according to the specific terms communicated when booked and, in any case, within the limits of amounts actually recoverable by the Host.
Failure by the guest to arrive, late arrival or early departure compared with the booked dates does not entitle the guest to any refund for unused nights or services, unless otherwise agreed in writing with the Host or otherwise required by mandatory law.
This cancellation policy must be made available to the guest before the booking is concluded and forms an integral part of the terms applicable to the booking.

22. Force majeure

The Host shall not be liable for any total or partial inability to provide the stay where this depends on unforeseeable and unavoidable events or events otherwise not reasonably controllable, such as natural disasters, fires, floods, measures taken by authorities, health emergencies, interruptions of essential services, acts of war or other force majeure circumstances.
In such circumstances, reasonable solutions compatible with the specific situation and applicable law will be adopted where possible.

23. Host liability

The Host is not liable for damage arising from the conduct, omissions or negligence of the guest, their companions or their pets.
The Host is also not liable for damage arising from events or circumstances not attributable to the Host, within the limits permitted by law.
Nothing in these terms is intended to limit or exclude liability which, under applicable law, cannot be excluded or limited.

24. Capacity and minors

The person making the booking declares that they have the legal capacity to enter into the relevant agreement and assumes responsibility for the persons included in the booking.
Minors must be accompanied and supervised by a responsible adult throughout the stay.
The Host assumes no responsibility for the supervision of minors.

25. Privacy and processing of personal data

Personal data provided by the guest will be processed in compliance with Regulation (EU) 2016/679 (GDPR), applicable Italian legislation and the Property's privacy notice.
The data may be processed, within the necessary limits, for booking management, performance of the relationship, administrative and tax obligations, public security obligations and further obligations established by applicable legislation.

26. Acceptance of the terms

By requesting and/or confirming the booking, the guest declares that they have read, understood and accepted these terms and conditions of stay.
The guest also undertakes to inform any accompanying persons of these rules and to ensure that they are respected.

27. Changes to the Terms and Conditions

The Host reserves the right to amend or update these terms in order to adapt them to legislative, organisational or operational changes.
Changes shall apply to new bookings made after their publication and shall not prejudice rights already acquired in relation to previously confirmed bookings, except as provided by law.

28. Applicable law and disputes

These terms are governed by Italian law.
For matters not expressly provided for, the provisions of applicable Italian law shall apply.
For any disputes, jurisdiction shall be determined according to the mandatory rules of law applicable to the relationship and, where permitted by applicable law, by the court of the place where the Property is located.

29. Final provision

Should one or more clauses of these terms be deemed null, invalid or ineffective, this shall not result in the invalidity of the remaining provisions, which shall continue to apply within the limits permitted by law.
These terms form an integral part of the conditions of stay at La Casetta della Cittadella.
